By downloading and using images from ClipartOf.com you agree to and are legally bound by the terms of this agreement, which also includes our no refund policy.

Refund Policy:

We list image sizes and give you visual samples. Since what you see is what you get on our site (minus the watermark) we cannot offer refunds. Please review your order very carefully prior to purchasing. If you require a JPEG sample, please contact customer service prior to purchase. They can provide you with a full sized, watermarked version.

Please note that you are responsible for seeking your own help with using images in programs and editing the files. We cannot be responsible for your inexperience of using images with programs, alterations, a typo that you entered in your email address, you purchasing the wrong file type, paypal using your original email address on file, resizing of the images, transparent backgrounds, etc. If you have any questions whatsoever, ask before purchasing. If you are having a problem with your download, you need to contact us IMMEDIATLY so we can help you. Do not procrastinate if you need help.

The Rest of Our Terms:

Our images are NOT free. You must purchase a license for each image that you want to use for ANY purpose. If you are caught using a watermarked image you will be fined for the image license. NO EXCEPTIONS.

Copyright is NOT transferred upon licensing of an image. When you pay, you are paying to use the image, not to own the image.

Images licensed are for the end user only, no additional parties.

Images may not be used as part of a copyrighted logo or a copyrighted trademark. They may be used for logo-type purposes but cannot be copyrighted or trademarked by anyone but our artist.

Licenses are not transferable. A license must be purchased for each image and each end user. If you have multiple clients that want to use the same image, you must purchase a license for each client. You cannot use the same license for more than one client.

If you are purchasing on behalf of a client, you MUST provide the client with a copy of the original receipt so they have proof of a license to use the image.

Images are non-exclusive, which means that others may also download and use the same image for competitive or other purposes.

Images may not be used on sites such as CafePress.com, polyvore.com, zazzle.com, redbubble.com, etsy.com, and other sites that may not be listed. We cannot offer refunds so if you are unsure, contact customer service prior to purchasing.

Images may not be distributed to other users via web templates. Each template user would need their own license.

Examples of acceptable uses are; t-shirts (restricted use on on-demand sites), blogs, business branding, marketing, websites, calendars, brochures, computer backgrounds, business cards, products (other than on on-demand sites), etc. Examples of restricted uses; distributing the digital file for free or for a fee, selling on on-demand sites, using the images on customizable products (invitations, templates, etc), templates, distribution of digitized embroidery files, copyrighting or trademarking the images. ClipArtOf.com holds no responsibility from any legal issues that may arise from ANY use of the end user. The end user is responsible for any legal issues or costs resulting in their use.

The end-user is responsible for all liabilities regarding privacy issues, trademarks, slander, libel, etc., that may arise from the use of the image(s).

You are responsible for the end-use and any legal and/or any financial liability that may arise from such use.

You may not use any image found on this site for any illegal or fraudulent purpose. Some of our images may include sensitive issues such as abuse or drugs. These images are intended for private personal use or for prevention of the issues and can NOT be used to promote drugs or illegal activities.

Distribution of the image(s) must be as an end product. You may not distribute the image(s) on a network, CD, website, or any other means, for free or for charge. Only the copyright holder and/or agent for the copyright holder may license or re-license these images. Again, you must purchase a license for each end user. Example; if you have a layout site for business cards, brochures or layouts, you would need to purchase the license for each customer that chooses to use one of our images. You would also need a license for each image to even display them on your site.

You shall indemnify and defend ClipArtOf.com and its image contributors against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses, arising out of or related to a breach of this Agreement, the use or modification of any Image or combination of any Image with any other material, your failure to abide by any restriction regarding the use of an Image, or any claim by a third party related to the use of an Image, alone or in combination with any other material.

ClipArtOf.com is not and cannot be held responsible for incorrect identification, titles, descriptions or captions of any images, such as the wrong identification name of a flower. It is up to the end user to make sure identifications are correct for their purposes.

Images may contain copyrighted material or trademarks. You are responsible for seeking legal counsel for your use of the image(s). You accept responsibility for all liabilities that may arise from your use of the image(s).
